End User License Agreement

END USER LICENSE AGREEMENT

This Finish User License Agreement (hereafter "the Agreement")

is a legal understanding betwixt yous and EIZO CORPORATION

(futurity "the Company") of the software product (futurity

"the Software") specified in Provision i of the Agreement.

By installing the Software, you are like-minded to exist bound by

these terms and weather condition in the Agreement. If you lot practise not

agree with these terms and conditions, please do not install,

copy or use the Software.

1. DEFINITION: The Software in the Agreement includes

a program or a data file made and provided by the

Company, and may include associated media, printed

materials and any online or electronic documentation,

all of which are provided by the Company.

two. GRANT OF LICENSE: The Company grants to you a

non-exclusive correct to use the Software on an unlimited

number of personal computers provided that y'all remain

responsible for the compliance of each user with the

terms and conditions hereof. The Company reserves

all rights not expressly granted under the Understanding.

iii. Ownership OF INTELLECTUAL Property:

The Company retains all rights, championship and ownership to

the Software,and the copyright and any other intellectual

properties concerning the Software.

4. Copy RESTRICTIONS: You may non copy the Software,

except that you may make a single re-create of the Software

for your own backup or archival purposes only. You

may not use the fill-in re-create for any purpose other than

reinstalling the Software in the computer mentioned

copying or copyright infringement which is caused or

encouraged by your failure to bide by the terms of

7. TERMINATION: This Understanding is effective until terminated.

The Agreement will terminate automatically, without find

from the Company and become null and void if you neglect to

comply with any provisions of the Understanding. Upon

termination, the Visitor may asking you to destroy the

Software and all copies of the Software. In addition to,

or instead of the request mentioned above, the Company may

request you to destroy the Software and all asking mentioned

in a higher place, the Company may claim damages confronting you.

8. Express WARRANTY: The Company disclaims all

warranties, express, implied, statutory or otherwise, including

without limitation, the implied warranties of merchantability,

fitness for a particular purpose, and nonexistence of virus

with respect to the Software.

9. LIMITATION OF LIABILITY: In no event, shall the Company

exist liable for any incidental, indirect, special or damages

consequential damages (including, without limitation,

damages for loss of business profit, business intermission,

loss of business organisation data, or whatsoever other pecuniary loss)

arising out of the employ or inability to employ the Software or in

whatsoever connection with the Software, except that such damages

are caused by the Visitor's intention or gross negligence.

10. GOVERNING Police force AND JURISDICTION:

(1) This Agreement shall exist construed in accord with

the laws of Japan.

(2) Whatever legal activeness to enforce or translate the terms of

this Agreement shall exist brought exclusively in the

Tokyo District Court,Tokyo, Japan.
